Teoría del discurso y Estado democrático de derecho. Un diálogo con otras perspectivas filosóficas sobre las implicancias morales, jurídicas y políticas de la razón práctica.

Abstract

La teoría del discurso, conceptualmente situada en el marco del giro lingüístico, pragmático y hermenéutico de la Filosofía contemporánea, plantea una ampliación de las concepciones del lenguaje y de la racionalidad que, y a diferencia del paradigma moderno, ya no se reduce al punto de vista del solipsismo metódico de la Filosofía de la conciencia, sino que subraya la dimensión esencialmente intersubjetiva, comunicativa del lenguaje y de la racionalidad como instancia conceptualmente ineludible para toda pretensión de solucionar racionalmente un problema teórico o práctico. Incluidos en este marco conceptual, los filósofos alemanes Karl-Otto Apel y Jürgen Habermas han desarrollado diversas propuestas teóricas que abarcan todas las áreas de la Razón Práctica: Ética, Política, y Derecho. En base a este trasfondo conceptual sobre el que se apoya la teoría del discurso y sus derivaciones teóricas, y continuando las investigaciones realizadas en proyectos anteriores, en este nos proponemos avanzar en el análisis de determinados problemas puntuales que resultan inherentes a la conexión entre las mencionadas áreas de la Filosofía práctica, pero ahora dialogando además con otras perspectivas filosóficas rivales de cada uno de estos ámbitos teóricos. Entre tales problemas pueden mencionarse la pretensión de compatibilizar política y religión en el marco de la democracia deliberativa, la definición de una teoría jurídica procedimental de la razón práctica, la relación entre ética del discurso y el realismo moral, o, también, el abordaje teórico que en este marco se realiza respecto de las emociones y el impacto que esto comporta sobre las discusiones actuales de la teoría política contemporánea. Así, el objetivo general de este proyecto es, entonces, identificar las contribuciones de la teoría del discurso al mejoramiento de la calidad institucional del Estado democrático de derecho.

Conceptually situated within the linguistic, pragmatic and hermeneutical turn of contemporary philosophy, the discourse theory proposes an expansion of the concepts of language and rationality that, unlike the modern paradigm, is no longer reduced to the point of view of the methodical solipsism of the Philosophy of Consciousness, but rather highlights the essentially intersubjective, communicative dimension of language and rationality as a conceptually inescapable instance for any claim to rationally solve a theoretical or practical problem. Included in this conceptual framework, the German philosophers Karl-Otto Apel and Jürgen Habermas have developed various theoretical proposals that cover all areas of Practical Reason: Ethics, Politics, and Law. Based on this conceptual background on which the theory of discourse and its theoretical derivations are based, and continuing the investigations already made in previous projects, in this we propose to advance in the analysis of certain specific problems that are inherent in the connection between the aforementioned areas of practical philosophy, but now also dialoguing with other rival philosophical perspectives in each of these theoretical fields. Such problems include the claim to reconcile politics and religion in the framework of deliberative democracy, the definition of a procedural legal theory of practical reason, the relationship between discourse ethics and moral realism, or, also, the theoretical approach that in this framework it is carried out with respect to the emotions and the impact that this entails on the current discussions of contemporary political theory. Thus, the general objective of this project is, then, to identify the contributions of discourse theory to the improvement of the institutional quality of the democratic rule of law. Such problems include the claim to reconcile politics and religion in the framework of deliberative democracy, the definition of a procedural legal theory of practical reason, the relationship between discourse ethics and moral realism, or, also, the theoretical approach that in this framework it is carried out with respect to the emotions and the impact that this entails on the current discussions of contemporary political theory. Thus, the general objective of this project is, then, to identify the contributions of discourse theory to the improvement of the institutional quality of the democratic rule of law.
