It seeks to identify the criteria used to determine the admissibility of these measures and the applicable procedure, given the absence of express statutory regulation in the provincial Code of Civil and Commercial Procedure. First, the study briefly examines legal scholarship and legislation in other jurisdictions. Drawing on the criteria identified, it then determines whether there are similarities or differences between those approaches and the case law developed in Entre Ríos.
The analysis concludes that courts in Entre Ríos have ruled on applications for these measures by applying admissibility criteria developed in legal scholarship and subsequently incorporated into provincial legislation. However, no uniform approach to the applicable procedure has emerged. Judicial approaches have evolved over the years, revealing a gradual shift from greater acceptance of granting relief without first hearing the opposing party toward a preference for hearing that party before issuing a decision. This development underscores the timeliness of expressly regulating this form of relief by statute.

The hypothesis is raised regarding the contradiction between the institution of dismissal for failure to prosecute and the civil procedural principle of procedural cooperation.
Throughout this thesis, an attempt is made to understand the advantages and disadvantages of the aforementioned institution and whether it affects, or not, one of the most important procedural principles in civil matters, namely the procedural cooperation of the parties.
The work aims to understand the arduous task of the litigating lawyer as well as that of the Judiciary from its internal perspective as the director of the process.

Los criterios y conclusiones plasmados en el trabajo se encuentran fundados en una gran cantidad de doctrina y jurisprudencia del Alto Tribunal Provincial.; Thirty years have passed since the Constitutional Reform of 1994, which brought about the necessary adaptation of legal doctrine and jurisprudence to the new constitutional and conventional parameters and standards.
This thesis addresses the individual "amparo" action, focusing on its legal, doctrinal, and primarily jurisprudential development, with an emphasis on the rulings of the Supreme Court of Justice of Santa Fe from 1994 to December 2024, inclusive.
The thesis covers topics such as: the type of procedure applied to "amparo" processes, jurisdictional issues (mainly those arising from administrative contentious jurisdiction), procedural standing, forfeiture periods, requirements for statements of claim and defense, "in limine" dismissal or declaration of incompetence, admissibility requirements, evidence, judgment, appeals, prohibited procedures, preliminary injunctions, and costs, among others.
The criteria and conclusions set forth in this work are based on a substantial body of doctrine and jurisprudence from the Provincial High Court.

In Argentina we do not have a special Law that clearly, uniformly and completely regulates the exercise of collective actions, and more specifically, that regulates actions aimed at protecting homogeneous individual rights.
It is necessary to establish a uniform and clear legal regime for cases in which the same fact affects homogeneous individual interests.
We are interested in this humble work, to bring the reader closer to the knowledge of class actions and highlight the operability in situations that require their approach from a process that allows the unification of demands in a single process, forming a claimant class, and making it possible to thus, access to justice.
We maintain that "Legislating class actions in Argentina would lead to an improvement in the judicial service as well as the right to defense, complying with the constitutional mandate to strengthen justice."
