Oficina Judicial en prisiones. El caso de la Oficina Judicial de la Unidad Penal N° 4 de la ciudad de Bahía Blanca

Abstract

Los estudios de la Sociología de la justicia penal exploran y analizan el funcionamiento de la justicia penal en su interior como así también las percepciones de los operadores jurídicos de su trabajo diario. En esa perspectiva de análisis son fundamentales las líneas que indagan el vínculo entre el contexto carcelario y la administración de justicia. Así, con la premisa de que las prácticas de la justicia penal deben ser analizadas en su funcionamiento efectivo es que nos centramos en el área de la ejecución de la pena, es decir, el ámbito en donde las personas están privadas de su libertad. Dentro de ese ámbito, en el interior de las cárceles de la Provincia de Buenos Aires, se encuentran las Oficinas Judiciales que forman parte del Poder Judicial y no del Servicio Penitenciario. Atendiendo a esta pertenencia, nuestro interés en esta investigación es explorar las relaciones de interdependencia que surgen de la Oficina Judicial con asiento en la Unidad Penal nro. 04 de Bahía Blanca con los detenidos alojados en esa penitenciaria, con el Servicio Penitenciario de ese penal y con los distintos órganos del área penal del Departamento Judicial de Bahía Blanca. Esta investigación es un estudio local y específico ya que solo analiza una Oficina Judicial y no todas las que existen en la mayoría de las cárceles bonaerenses, pero también hay un interés en mostrar el funcionamiento de las Oficinas Judiciales en sentido general.

Studies in the Sociology of Criminal Justice explore and analyze the inner workings of the criminal justice system, as well as the perceptions legal practitioners have of their daily work. Within this analytical perspective, research lines investigating the link between the prison context and the administration of justice are fundamental. Thus, based on the premise that criminal justice practices must be analyzed in their actual operation, we focus on the field of sentence execution that is, the environment where individuals are deprived of their liberty. Within this sphere, inside the prisons of the Province of Buenos Aires, are the Judicial Offices (Oficinas Judiciales), which are part of the Judiciary rather than the Prison Service. Given this institutional affiliation, our research interest lies in exploring the relationships of interdependence that emerge between the Judicial Office located at Prison Unit No. 04 in Bahía Blanca and the detainees housed there, the Prison Service of that facility, and the various criminal justice bodies of the Bahía Blanca Judicial Department. This research is a local and specific study, as it analyzes only one Judicial Office rather than all those existing in most provincial prisons; however, there is also an interest in demonstrating the functioning of these offices in a general sense.
