Traslados Médicos Judiciales en el marco de la Ley Nacional de Salud Mental Nº 26.657, y su impacto en la Secretaría de Emergencias y Traslados 107 del Gran Santa Fe. Año 2023

Abstract

La Ley de Salud Mental Nº 26.657 ha recibido numerosas críticas desde que fue sancionada en 2010, entre ellas y quizás la más importante, la dificultad para su operacionalización en una red y estructura de atención y contención que nunca se preparó para tal fin, y ante la falta de decisión política real como operador del instrumento legal. Los efectos de dichas falencias se reflejan, entre otros, en una creciente demanda al SET 107 de asistencia de crisis psiquiátricas agudas e internaciones involuntarias solicitadas a través de oficios judiciales. El presente estudio se propuso evaluar el impacto en el SET de los Traslados Médicos Judiciales (TMJ) solicitados para llevar a cabo las mencionadas asistencias en el área del Gran Santa Fe, en términos de la estructura general disponible para dar respuesta al evento. Para tal fin se llevó a cabo un estudio transversal, observacional, basado principalmente en los datos de los registros del Sistema Integrado de Emergencias Sanitarias (SIES) y de registros internos del servicio, en la construcción de indicadores específicos y en un análisis descriptivo de ciertas variables de interés. Ante una creciente demanda y un marco legal cuestionado por su viabilidad, los resultados obtenidos en este estudio interpelan la actual dinámica de abordaje de los TMJ: partiendo de una estructura con recursos humanos y móviles insuficientes, los TMJ son, en su mayoría, eventos de baja prioridad a los que se asignan recursos de alta complejidad, que se superponen con la cobertura de otros eventos de mayor prioridad y gravedad, impactando directamente en la eficiencia de respuesta del servicio del SET 107.

The Mental Health Law No. 26,657 has received numerous criticisms since it was passed in 2010, among them and perhaps the most important, the difficulty of operationalizing it in a network and a structure of care and containment that was never prepared for this purpose, and in the absence of a decision real politics as operator of the legal instrument. To this end, a cross-sectional, observational study was carried out, based mainly on the data from the records of the Integrated Health Emergency System (SIES) and from in the construction of specific indicators and in a descriptive analysis of certain variables of interest. In the face of a growing demand and a legal framework questioned for its viability, the results obtained in this study question the current dynamics of approach to JTM: starting from a structure with insufficient human and mobile resources, TMJs are mostly to which highly complex resources are assigned, which overlap with the coverage of other events of higher priority and severity, directly impacting the efficiency of response of the SET 107 service.
