Testamento videograbado en Argentina. Su reconocimiento en la legislación argentina

Abstract

Este trabajo concluye que el testamento videograbado es una herramienta necesaria y viable para el ordenamiento jurídico argentino. El sistema actual, basado en un formalismo rígido de origen romano, resulta anacrónico e inadaptado a la era digital. La pandemia de COVID-19 evidenció sus limitaciones, imposibilitando a muchas personas aisladas manifestar su última voluntad. El testamento en video no es una mera novedad tecnológica: permite capturar la voluntad, el estado mental y el contexto emocional del testador con mayor claridad y autenticidad que el escrito, humaniza el acto y previene litigios futuros. El derecho comparado respalda esta evolución, destacándose el Código Civil de China (2021), que regula expresamente los testamentos por video, así como experiencias en Puerto Rico, Estados Unidos, Canadá y Australia. Si bien existen desafíos técnicos y legales (autenticidad, integridad del archivo, conservación y accesibilidad), estos son superables mediante una regulación robusta: requisitos formales estrictos, testigos, intervención notarial, firma digital y un sistema público de custodia. Se propone, por tanto, una ley específica que incorpore el “testamento videograbado” al Código Civil y Comercial, en lugar de forzar analogías con figuras existentes. En síntesis, el reconocimiento legal de esta modalidad es posible, necesario y urgente. Representa una evolución coherente del derecho sucesorio, amplía la autonomía de la voluntad, brinda mayor seguridad jurídica y se adapta a la realidad social y tecnológica del siglo XXI.

This research concludes that the video-recorded will is a necessary and viable tool for the Argentine legal system. The current system, based on rigid formalism rooted in Roman law, is anachronistic and ill‑adapted to the digital age. The COVID‑19 pandemic exposed its limitations, preventing many isolated individuals from expressing their last will. The video will is not merely a technological novelty: it captures the testator’s intent, mental state, and emotional context with greater clarity and authenticity than a written document. It humanizes the act of testating and helps prevent future litigation. Comparative law supports this evolution, notably China’s Civil Code (2021), which expressly regulates audio‑video wills, as well as experiences in Puerto Rico, the United States, Canada, and Australia.Although there are technical and legal challenges (authenticity, file integrity, long‑term preservation, and accessibility), these can be overcome through robust regulation: strict formal requirements, witnesses, notarial oversight, digital signatures, and a public custody system. Therefore, the study proposes a specific law incorporating the “video‑recorded will” into the Civil and Commercial Code, rather than forcing analogies with existing instruments. In summary, legal recognition of this modality is possible, necessary, and urgent. It represents a coherent evolution of succession law, expands testamentary freedom, provides stronger legal certainty, and adapts to the social and technological reality of the 21st century.
