El Derecho y el fenómeno científico-tecnológico. La regulación de conductas humanas en los entornos digitales y la necesidad de proteger las libertades individuales

Abstract

Assuming that the Law is not the only regulator of human behavior but that it coexists with other mechanisms which regulate human activities in different ways, the main issue addressed in this thesis is the study of the ‘Code’, understood as the set of rules and instructions which determine how the hardware and software that constitute electronic devices and computer systems and networks which characterize modern societies are configured. This paper deals with the classic tension between freedom and control in the context of technological societies, but it is analyzed specifically in the light of certain particular problems posed to the Law by the emergence of that powerful - and silent- regulator of human behavior: the Code. The conclusion drawn is that it is necessary to create a new legal principle—namely, the principle of self-determination and protection of individual freedoms in digital environments—in order to guard the individual in the societies of science and technology. From this new principle, rights would emerge ensuring participation, granting the power to obtain information on the technological architecture and, after learning the technical rules of digital environments, allowing the individual to control its design and even refuse to use those computer systems that affect individual rights and freedoms. In sum, new legal tools are proposed aiming at increasing the participation of individuals in the "construction" of digital environments.

Partiendo de la base de que el Derecho no es el único regulador de conductas humanas sino que coexiste con otros mecanismos que regulan las actividades del hombre de diferentes maneras; la tesis direcciona su principal interés en el estudio del Código Informático, entendido éste como el conjunto de reglas e instrucciones que determinan el modo en que están configurados el hardware y el software que forman parte de los dispositivos electrónicos, sistemas y redes informáticas que caracterizan a las sociedades modernas. Este trabajo aborda la clásica tensión entre libertad y control en el marco de las sociedades tecnológicas; pero se estudia específicamente a partir de ciertos problemas puntuales que plantea al Derecho la irrupción de ese poderoso –y silencioso- regulador de conductas humanas que es el Código Informático. Se arriba a la conclusión de que es necesario pensar un nuevo principio jurídico –denominado de autodeterminación y protección de las libertades individuales en los entornos digitales- a fin de tutelar al individuo particular en las sociedades de las ciencias y las técnicas; del cual emergerín derechos que garanticen la participación del individuo, le otorgue la facultad de obtener información sobre la arquitectura tecnológica y luego de conocer las reglas técnicas de los entornos digitales, le permita controlar su diseño e incluso oponerse a la utilización de aquellos sistemas informáticos que afectan derechos y libertades individuales. En suma, se piensan nuevas herramientas jurídicas para incrementar la participación de los individuos en la “construcción” de los entornos digitales.
