El concepto de Imputación en el Derecho penal

Abstract

La tesis aborda el estudio de dos conceptos diversos de imputación utilizados por el Derecho penal. El primero de ellos, "el concepto amplio de imputación", abarca no solo la atribución del hecho al autor, sino también la atribución del mismo como culpable. Para el segundo de los conceptos, la imputación es un conjunto de criterios normativos tendientes a determinar los resultados imputables al autor. En lo que respecta a este segundo concepto se analizan tres modelos diversos, a saber, los pertenecientes a: Claus Roxin, Günther Jakobs y Wolfgang Frisch

This investigation is a comparative study of two differents concepts of Imputation that exist in Criminal Law. The first one, "the whole imputation" considers that the act of imputation includes not only the impution of the fact, but also the imputation as "guilty". the second concept of imputation, "the objective imputation of a criminal result" consists in legal judgments in order to ascribe a result to the author. In order to this concept we analise three different models, namely the theories developed by Claus Roxin, Günther Jakobs and Wolfgang Frisch.
