La violencia de género en la partición mixta

Abstract

En el trabajo se analiza el caso de un acuerdo particionario presentado al juez de la sucesión pidiendo la homologación, del que surge que la heredera (género femenino) recibe notoriamente menor cantidad de bienes del acervo que el heredero hombre -o directamente no recibe ninguno-. Los sucesores no aclaran nada sobre estas desigualdades. Se intenta responder al interrogante acerca de cómo debe proceder el juez; cuáles son los deberes y obligaciones que pesan sobre la magistratura. Finalmente, ante la denuncia de violencia de género, se estudia el camino procesal que puede tomar la heredera afectada, trámite que posee particularidades propias de la temática en virtud de su vulnerabilidad.

The work analyzes the case of a partition agreement presented to the succession judge requesting homologation, from which it appears that the heir (female gender) receives significantly less assets from the estate than the male heir - or does not receive any at all. . The successors do not clarify anything about these inequalities. An attempt is made to answer the question about how the judge should proceed; What are the duties and obligations that lay upon the judicary. Finally, when faced with a complaint of gender violence, the procedural path that the affected heir can take is studied, a procedure that has particularities specific to the topic due to its vulnerability.
