Reflexions about emergencies during the pandemic in Santiago del Estero https://bibliotecavirtual.unl.edu.ar/publicaciones/index.php/papeles/article/view/14096 <p><span style="font-weight: 400;">The Coronavirus (Covid 19) emergency in Argentina highlighted the multiple challenges that affect the most vulnerable social sectors in critical moments of collapse, given their historical difficulties in accessing basic services. This article focuses on the period 2020-2022, the pandemic stage, based on a qualitative design that triangulates primary and secondary sources with the development of a case study in the city of Selva, province of Santiago del Estero. The results advise about health and non-health consequences of the emergency. The research managed to reveal organizational processes at the community level and the way in which the context situation deepened pre-existing critical conditions. This entails a contributory coverage scheme, based mainly on financing through contributions from workers and employers.&nbsp;</span></p> <p><span style="font-weight: 400;">In this work, we will synthesize the various coverage systems for social contingencies - old age, disability, death, illness, work accident, family responsibilities, maternity, unemployment - for registered workers, and which constitute the central structure of the public policy of protection.</span></p> <p><span style="font-weight: 400;">However, we do not fail to point out that, in a context with high rates of labor informality, a large part of the population is left out of that Social Security contributory umbrella. </span> <span style="font-weight: 400;">For this group of people, non-contributory or assistance schemes subsidiarily establish protection against social contingencies.</span></p> <p><span style="font-weight: 400;">This leads to the need to design public policies in line with the current reality, which contemplate various situations and modalities: informal work, independent work, teleworking/work 4.0, care work, migrant work/digital nomads.</span></p> María Celeste Cóceres Copyright (c) 2024 María Celeste Cóceres https://creativecommons.org/licenses/by-nc-sa/4.0 https://bibliotecavirtual.unl.edu.ar/publicaciones/index.php/papeles/article/view/14095 Thu, 19 Dec 2024 00:00:00 +0000 The incorporation of the plaintiff in the New Juvenile Criminal Procedural Code of Santa Fe. Its origin in the light of constitutional and conventional principles https://bibliotecavirtual.unl.edu.ar/publicaciones/index.php/papeles/article/view/14094 <p><span style="font-weight: 400;">The present research work aims to contribute to investigate whether the incorporation of the figure of the plaintiff in the new Juvenile Criminal Procedure Code of the province of Santa Fe is in line with the principles, standards and fundamental norms of the system for the comprehensive promotion of the rights of children and adolescents. The constitutional principles involved will be presented, as well as the international corpus iuris of protection of the rights of young people in criminal matters, with emphasis on the principle of specialty and the dominant paradigm of the best interests of the child. Likewise, the specialized opinion of the doctrine will be reflected in reference to the subject, and reference will be made to the direction followed by the jurisprudence of our courts in relation to the constitution of the plaintiff in criminal proceedings against children and adolescents. The role of psychological reports in the Gesell Chamber https://bibliotecavirtual.unl.edu.ar/publicaciones/index.php/papeles/article/view/14092 <p><span style="font-weight: 400;">The regulation of the Gesell Chamber (hereinafter GC) system in the criminal procedural legislation of the province of La Rioja has two shortcomings: 1) Lack of systematisation in its regulation and, consequently, 2) Denial of the special vulnerability of children and adolescents (hereinafter BGTY) victims or witnesses of crimes who must testify through this procedure. Both weaknesses hinder the proper use of this tool and at the same time especially affect the rights of children and adolescents who must go through a judicial procedure -especially in the face of events that affect their sexual integrity-.
