Principio Protectorio en el Derecho del Trabajo

Abstract

El presente trabajo versa sobre el pilar por excelencia del derecho laboral, que inspira su filosofía y atraviesa todo el ordenamiento jurídico laboral. Asi, se considerará el Principio Protectorio y su vinculación con los otros Principios. Se observará su manifestación tanto en el derecho de fondo Argentino consagrado en la Ley de Contrato de Trabajo fundamentalmente, como en el marco del Derecho Internacional Laboral consagrado actualmente en las normas y recomendaciones de la Organización Internacional del Trabajo, a los efectos de demostrar la vanguardia y actualidad del mismo, el cual encuentra nuevas manifestaciones al ser llamado a proponer una solución justa y humana en las distintas situaciones con el fin de crear un marco de igualdad y justicia social en su intervención. Se observará finalmente su actualidad en la evolución dentro del Derecho Procesal Laboral y su permanente consagración jurisprudencial. Finalmente se reflexionará sobre su vigencia e importancia a la hora de pensar sobre el factor de ajuste en la empresa, rompiendo una visión economicista del derecho para tener una mirada humanista de quien pone su cuerpo, tiempo e inteligencia de modo directo en la relación laboral.

The present work deals with the quintessential pillar of labor law, which inspires its philosophy and runs through the entire labor legal system. Thus, the Protective Principle and its link with the other Principles will be considered. Its manifestation will be observed both in the Argentine substantive law fundamentally enshrined in the Labor Contract Law, and in the framework of International Labor Law currently enshrined in the norms and recommendations of the International Labor Organization, in order to demonstrate the avant-garde and relevance of the same, which finds new manifestations by being called to propose a fair and humane solution in different situations in order to create a framework of equality and social justice in its intervention. Finally, its actuality will be observed in the evolution within the Labor Procedural Law and its permanent jurisprudential consecration. Finally, we will reflect on its validity and importance when thinking about the adjustment factor in the company, breaking an economistic vision of law to have a humanistic view of those who put their body, time and intelligence directly in the employment relationship.
