The Use of Foreign Law in Transitional Justice in Colombia: An Analysis of the Institutional Design for Truth

The lessons for the design and implementation of the Peace Agreement in Colombia between the National Government and the FARC-EP present an innovative character, nourished by different international experiences whose analysis by the doctrine seems to ignore the solid but debated studies on how foreign law should be compared and used. Based on a hypothetical-deductive methodology supported by indirect documentation, the objective is to analyze the use and reception of foreign law on truth commissions in the framework of transitional justice processes in the Peace Accords in Colombia. With a defense on the need for comparison, the article concludes that the experience of foreign law for the Colombian case or other cases is relevant and important to achieve the objectives of peace. However, it is necessary to recognize the differences and the historical and interdisciplinary construction of the social contexts that led to the initiation of transitional justice processes.
