Binding Public Administration to administrative and judicial precedentes: mechanisms of equal protection of social rights

Analyzing the problem of unequal satisfaction of social rights by the Brazilian Public Powers, the article proposes, as a mechanism for equal protection of such rights by administrative organs, the recognition of the binding nature of the administrative and judicial precedents to Public Administration. To sustain the administrative duty to respect their previous decisions in the field of social rights and also the judicial precedents on the subject, the article presents constitutional foundations that underlie the referred duty, the necessary requirements for its configuration and a few concrete examples.
