The built to suit contract in the public sphere and the new Brazilian bidding law

The contracting in the model built to allow the enjoyment and adaptation of third-party properties or adaptation of Public Administration properties, without the immediate commitment of budgetary resources. In such contracting, the financial contribution is given in a different way, as opposed to what occurs in a work or engineering service integrated to the expenses of the Public Authority. The one built to serve helps in the immediate exemption of public investment with an infrastructure execution and the consequent allocation of resources to the realization of public services outlined in the Federal Constitution. However, with the supervening of Law No. 14,133/2021, which determined the repeal of the provisions that authorized the use of the institute in the public sphere, uncertainty was generated regarding the legality of the use of the respective contracting model by the Public Administration, under the new paradigm. This study analyzes whether there is support for the application of built to suit in the public sphere, as well as establishing the legal parameters to be observed under the archetype of Law No. 14.133/2021.
