Facing fake news and hate speech: a new regulatory model for social media

Abstract

Through bibliographical and jurisprudential analysis, the methods of regulating social media in the United States of America, Germany and Brazil were studied. All the regimes demonstrated flaws that impede the effective defence against Fake News and Hate Speech. Therefore, the adoption of a mixed regulatory model is suggested, through which the State and the platform hosting the debate would have the shared attribution to regulate content ex-post. This tactic would permit the maximization of freedom of speech, without disregarding respect for human dignity. Additionally, the proposed model would allow the State’s regulatory capacity not to be excluded on the grounds of the host platform being a private entity, while still permitting the platform’s self-regulatory practices (which are typically quicker and more efficient than governmental measures).
