An empiric approach to the annulment activity of the Public Administration in Argentina

The annulment power of the Public Administration is one of the topics that draws most attention in the Argentine administrative doctrine. However, this issue has been approached mainly from a legal-dogmatic point of view, without any empirical studies on the matter. This last type of approach, however, is of interest since it would make it possible to inquire, among other things, how often administrative acts are annulled, on what issues the annulled acts are mostly based, who are the most affected by the annulment and what procedures are applied in practice. In this paper, we made an empirical approach to the annulment activity, including in this examination the ex officio, the judicial actions for annulment and the annulments requested by administrative appeals. To this end, we present and analyze the results of 18 requests for access to public information formulated to the ministries of the National Public Administration existing at the end of the period 2022. The paper also distinguishes the annulments according to the subject they dealt with and reviews the procedure applied according to what was indicated in the administrative acts. Finally, we discuss the implications of the results.
