Conventionality and right of access to information: case study of requirement on supervision onf international judgment in the Brazilian Electronic System of the Citizen Information Service (e-Sic)

The Brazilian Federal Constitution of 1988 follows a world trend after the 2nd World War of valuing and protecting the fundamental rights of the citizen. In this context, the article seeks to analyze the human right of access to public information, both constitutionally and internationally, through the provisions of the American Convention on Human Rights and the International Covenant on Civil and Political Rights. It also investigates the law in the Brazilian legal system and how compliance is developed. The method chosen was inductive, as part of the analysis of the request for information request about the Garibaldi vs. Brazil presented before the Electronic System of the Citizen Information Service (e-Sic). The study concludes that the Brazilian legal system presents advances, such as the enactment of the Access to Information Law (Law No. 12,527 / 2011), but that there is a need for improvement to achieve the full realization of that right to achieve citizenship in the light of conventionality.
